General Terms and Conditions (GTC) - Holiday apartments "Goethe's Auszeit, Goethe's Bergblick, Goethe's Panorama and Goethe's Aussicht" Goethestr. 1 in 38667 Bad Harzburg and Apartment Harzstay Am Breitenberg 41-4 in 38667 Bad Harzburg
Landlord: Harzburgliving, Owner: Kristin Bullach, Goethestr. 33, 38667 Bad Harzburg
1. Arrival / Check-In / Departure
Check-in begins at 3:00 PM. Departure must be by 11:00 AM on the day of departure at the latest. Other arrival and departure times can be individually agreed upon with the landlord. If the tenant does not arrive by midnight on the day of arrival, the contract will be deemed terminated after a period of notice of 48 hours without notice to the landlord. The landlord or their representative may then freely dispose of the property. A (pro rata) refund of the rent due to early departure is generally not possible.
The code and instructions for checking in via the key safe will be provided on the day of arrival, after the guest has correctly entered their details on the online check-in form and returned it to the host. This form will be sent via email. If the form is not completed online by 2 p.m. on the day of arrival, a photo of their passport will be required.
Without registration, accommodation is not permitted; all guests must be named.
2. Booking
The booking of the holiday accommodation is confirmed by the booking confirmation, which is sent to the guest following the online booking. Upon receipt of the booking confirmation, the booking is legally binding. By booking, the guest also accepts these general terms and conditions and the house rules, which were made available to the guest in advance.
3. Special requests
Special requests and additional agreements are generally possible. They require written confirmation from the landlord.
4. Payment
The guest is obligated to pay the landlord's applicable prices for the use of the holiday accommodation and any additional services used. The invoice amount must be paid no later than 14 days prior to arrival. Payments must be transferred to the landlord's account. For short-term bookings, the total price must be transferred immediately after booking confirmation. In the event of late payment, the guest will receive a payment reminder. If payment is not made subsequently, reminders will be sent to the guest, each with a reminder fee of €5.00. Non-payment is considered cancellation and entitles the guest to re-rent the property. Additional costs for water and waste disposal are not charged. Energy costs are only charged if unusual consumption occurs.
5. Withdrawal
You may withdraw from the contract at any time. Your withdrawal must be made in writing.
The date of receipt of your cancellation notice is the determining factor. Any amounts already paid will be offset.
You can, after consultation, provide a replacement person who will enter into your contract under the stated conditions.
Cancellation of the contract by the landlord is permitted in the event of force majeure or other unforeseeable circumstances that make the booked stay impossible. In this case, liability is limited to the refund of the rental price. Any payments already made will then be refunded to the guest in full. In the event of a justified cancellation, the guest is not entitled to compensation. Liability for travel and hotel costs is also excluded. We recommend taking out travel cancellation insurance.
6. Tenant’s obligations
The tenant undertakes to treat the rented items (accommodation, inventory, and outdoor facilities) with care. If damage to the accommodation and/or its inventory occurs during the rental period, the tenant is obligated to notify the landlord immediately. Defects and damage discovered upon arrival must be reported to the landlord immediately; otherwise, the tenant is liable for these damages. A reasonable period of time must be allowed for the rectification of damages and defects. Claims for complaints not reported immediately on site are excluded. Complaints received by the landlord only at the end of the stay or after vacating the holiday home are also excluded from compensation. In the event of any disruptions in service, the tenant is obligated to do everything reasonable within the scope of their legal obligations to help remedy the disruption and minimize any damage. On the day of departure, the tenant must remove personal belongings, dispose of household waste in the designated containers, and store clean and washed dishes in the kitchen cupboards.
7. Failure to comply with the house rules
The host reserves the right to terminate the contract without notice and without reimbursement in the event of violations of the house rules and common decency (such as noise, unauthorized visitors, and smoking in the apartment).
8. Smoking is not permitted
Smoking is strictly prohibited in the apartments. Failure to comply will result in a cleaning fee of €250.
9. Dogs
Dogs are permitted by arrangement and may be brought along under the following conditions:
a) Dogs are not allowed on the bed, couch, sofa or other lying or sitting areas in the accommodation.
b) The tenant is responsible for ensuring that his dog does not cause any damage to the accommodation or its contents.
c) The dog must be supervised at all times to avoid disturbance or nuisance to other tenants or neighbors.
d) All dog droppings must be removed promptly and properly by the tenant.
e) The tenant is liable for all damage caused by the dog.
f) The dog owner is obliged to have valid liability insurance for the dog and to provide proof of insurance to the landlord upon request.
In case of non-compliance with the above regulations, the landlord reserves the right to charge a special cleaning fee of €250. This fee is intended to cover the additional cleaning costs resulting from the presence of the dog and the non-compliance with the rules. The guest assumes full responsibility for any damage caused by the guest or their dog to the accommodation or its contents. The landlord is not liable for any injuries or damage caused to the guest or their companions by the dog or other animals during their stay. The guest agrees to indemnify the landlord against any claims or demands that may arise in connection with bringing their dog.
10. Electric cars
Charging a vehicle with household electricity via a socket is prohibited.
11. Liability
The landlord is liable, within the scope of his duty of care, for the proper provision of the rental property. Liability for any failures or disruptions in the water or electricity supply, as well as events and consequences due to force majeure, is excluded. Likewise, no liability is assumed in the event of unforeseeable or unavoidable circumstances such as official orders, pandemics, sudden construction work, or disruptions due to natural or local events. The landlord also assumes no liability for the loss of items or theft in the house or on the property. The guest is liable for any damage caused intentionally or through gross negligence. Arrival and departure are also the guest's own responsibility and liability. The tenant is liable for the loss of the keys to the holiday accommodation.
12. Severability Clause
Should individual provisions of these General Terms and Conditions be invalid or unenforceable, or become invalid or unenforceable after their knowledge, this shall not affect the validity of the remaining provisions of these General Terms and Conditions. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision whose effects come as close as possible to the economic objectives pursued by the parties with the invalid or unenforceable provision.
13. Final provisions
Photos and text on the website and in the flyer serve to provide a realistic description. Full conformity to the rental property cannot be guaranteed. The landlord reserves the right to make changes to the furnishings (e.g., furniture) provided they are of equivalent quality. German law applies. The place of jurisdiction and performance is the landlord's place of residence.
